Local Business Being Sued for Trademark Infringement

A retail chain with nearly 50 locations around the country is suing a business in the Lakes Region over trademark infringement.

According to multiple media reports, Buc-ee's, Ltd of Texas is suing 2 Wiseman Enterprises, LLC of Kansas City claiming that their name and logo for their Duckees Drive-Thru Store in Kimberling City infringes on their copyrighted name and logo for Buc-ee's Stores located in nine states including in Missouri east of Springfield. 

Buc-ee's has been operating travel centers in Texas since 2003 and began expanding outside the state in 2018 with the Springfield Location opening last December. 

Duckees Drive-Thru on Highway 13 was bought by the current owners in April of 2023.

The suit was filed in the Western District of Missouri Federal Court in Kansas City in November.  Online documents indicate the suit has been submitted to the court's, mediation program for review by Federal Judge Roseann A Ketchmark.
