An Omaha man is facing charges after allegedly selling a cargo trailer he had not made payments on and was repossessed from the new owner.
According to the probable cause affidavit, on November 17 the Boone County Sheriff’s Office was contacted by a person who wanted to make a theft report. The victim stated on June 8 he purchased a cargo trailer from 29-year-old Robert Culver, Jr. of Omaha for $4,500 in cash. He stated Culver told him he was waiting on the title and would send it to him soon. Culver provided the victim with a bill of sale stating he would provide the title in a few weeks.
The victim told authorities he obtained a photograph of Culver’s driver’s license while purchasing the trailer. He stated over the last few months he would attempt to contact Culver in reference to the title, but Culver would state he didn’t not have it yet or he was out of town.
On the day the victim made the report, he advised law enforcement a company showed up at his home to repossess the trailer and learned Culver has purchased the trailer from the company, made one payment and then sold the trailer to him. The man attempting to repossess would not give the victim much information except only one payment had been made and they used the tracking device on the trailer to locate it. No paperwork was provided to the victim.
On November 18, the victim contacted Culver asking if he wanted to purchase the trailer back. Culver responded yes and stated he still had the title at his home. At the time, Culver was unaware the trailer had been repossessed and allegedly was still lying about having possession of the title.
Culver was booked and released from the Boone County Detention Center on one felony count of theft of property. He was released on a $4,500 cash only bond.
